Terms of Use

We wrote these Terms to be read by actual humans. If anything here isn't clear, email us and we'll explain it like a person — not a lawyer.

1. What PocketCaregiver is — and what it isn't

PocketCaregiver is a simple tool to help you track and organize a loved one's day-to-day health at home. It helps you log the day, notice patterns, and walk into a doctor's visit organized instead of overwhelmed.

What it does: It records the information you enter. It can remind you about refills and appointments, and it can notify you when a reading falls outside a range you have set, or outside the general adult reference ranges published by the American Heart Association, American Lung Association, CDC, and American Diabetes Association if you have chosen to use those as a starting point.

What it does not do: PocketCaregiver is not a medical device. It does not diagnose, treat, or provide medical advice, and it does not evaluate whether any reading is medically significant for your loved one. Reference ranges are general population guidelines — your loved one's doctor may have set different targets for them, and the doctor's guidance always governs. Only a healthcare professional can interpret what a reading means.

It is never a substitute for a doctor, nurse, or professional care. In an emergency, call 911 (or your local emergency number) — do not rely on the app. Always follow your healthcare provider's guidance.

2. Who can use it

You must be 18 or older to create an account. Right now, PocketCaregiver is for tracking the health of adult care recipients. Please don't use it to track a child or minor at this time.

(This matters to us personally. We plan to build proper, privacy-first support for tracking children in the future — done right, not bolted on. When we do, we'll update these Terms.)

You may only add a care recipient if you are that person, or if you have their permission or the legal authority to act on their behalf (for example, as a healthcare proxy, power of attorney, or guardian). You're responsible for making sure you have that authority, and for keeping your care circle limited to people the care recipient would want to have access.

3. Your account and your care team

You're responsible for keeping your login safe and for who you invite as caregivers. Anyone you give access to can view and add to that loved one's information — so only invite people you trust. You can remove a caregiver's access anytime.

4. Plans, prices, and billing

Payments are handled securely by Stripe — we never see or store your full card number. Paid plans renew automatically at the end of each period until you cancel. Prices are in U.S. dollars; taxes may apply.

• Plus — $14.99/month or $149/year (14-day free trial).

5. Free trials

Your trial is genuinely free. We won't charge you until the trial ends. Cancel before it ends and you pay nothing.

6. Cancelling and refunds

You can cancel anytime from your billing settings — no phone calls, no guilt. Cancelling stops any future charges, and you'll keep access until the end of the period you've already paid for.

If an automatic renewal charged you when you meant to cancel, just email us within 14 days and we'll refund it. We don't otherwise refund the current billing period — but if something has gone wrong, please reach out and we'll do our best to make it right.

7. When a loved one passes away

We built this part with care. If you mark a loved one as passed away, PocketCaregiver enters memorial mode. You can also pause tracking anytime if care is on hold.

Memorial mode keeps your loved one's full history available to you for as long as you keep your account, on any plan. Billing stops at the end of your current period and never renews — you're never charged after a loss, and we will never send you an upsell or "win-back" message.

If you ever want the record permanently removed, you can delete it from your account settings at any time. That choice is always yours.

8. Your data belongs to you

You own the information you put in. You can export or delete it anytime. How we protect and handle it is spelled out in our Privacy Policy.

9. Summaries and exports

The doctor-ready summaries and exports are for your information and to share with your care team — they are not official medical records. They're a helpful snapshot, not a certified or complete medical chart. Your provider's records are the source of truth.

10. Using it fairly

Please use PocketCaregiver only for its intended purpose and only in lawful ways. Don't try to break it, misuse it, or reach parts of the service that aren't yours.

11. Changes

We'll keep improving PocketCaregiver, and we may update these Terms as it grows. If we make a meaningful change, we'll let you know. Continuing to use the app means you accept the current Terms.

12. Our responsibility (and its limits)

We work hard to make PocketCaregiver reliable and helpful, but it's a tool, provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that alerts and reminders will always be delivered.

We can't be responsible for medical decisions or outcomes, or for anything you or a healthcare provider does or doesn't do based on what's in the app.

To the fullest extent permitted by law, PocketCaregiver and Nerd Nurse AI LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, or data, even if we've been advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty U.S. dollars.

Some states don't allow certain limitations, so parts of this section may not apply to you.

13. Governing law

These Terms are governed by the laws of the State of New Jersey, USA.

13a. Resolving disputes

We'd much rather solve a problem by email. If we can't, this section explains what happens next — please read it carefully, because it affects your legal rights.

Individual arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of PocketCaregiver will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be seated in New Jersey, or conducted remotely at your election. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

Jury trial and class action waiver. You and PocketCaregiver each waive any right to a trial by jury. You and PocketCaregiver each waive any right to bring, join, or participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only to the individual party seeking it, and only to the extent necessary to resolve that individual's claim.

Small claims exception. Either of us may bring an individual claim in small claims court instead of arbitration, if it qualifies.

Your right to opt out. If you're a new user, you may opt out of this arbitration agreement by emailing support@pocketcaregiver.com within 30 days of first accepting these Terms, with your account email and a statement that you are opting out. If you were already a PocketCaregiver user before September 9, 2026, you may opt out within 30 days of that date instead. Opting out does not affect any other part of these Terms, and we will not treat you differently for doing so.

Survival. This section survives termination of your account.

15. The legal housekeeping

Severability. If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it can't be. Everything else stays in full effect. If the class action waiver in Section 13a is found unenforceable, the entire arbitration agreement in Section 13a is void, and disputes will be resolved in the state or federal courts located in Bergen County, New Jersey.

Entire agreement. These Terms, together with the Privacy Policy, are the whole agreement between you and us about PocketCaregiver, and replace anything said or written before.

No waiver. If we don't enforce a provision right away, that doesn't mean we've given it up.

Assignment. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you. You may not assign them.

Language. These Terms are also available in Spanish for your convenience. If there's any conflict between versions, the English version governs.

Force majeure. We're not responsible for delays or failures caused by events outside our reasonable control.
